According to the Complaints Act, a complaint is a request for putting an end to a violation of individual rights or interests the assessment of which does not fall under the scope of any other proceedings, including in particular judicial or administrative proceedings. A complaint may also contain a proposal.

It is possible to submit a public interest disclosure via the secure electronic system or in person at our Complaints Office.

Public interest disclosures / whistleblower reports may be submitted electronically with Client Gate identification, or without identification. In the case of reports submitted without such identification, the OCFR will send an identification letter to the whisteblower by post. Identification by post may be done in two different ways: after the acceptance of the letter, by sending the acknowledgement receipt to the OCFR, or by your login to our homepage (https://www.ajbh.hu). You can inquire after your case by using the menu items Administration / Inquiry after my public interest disclosure / whistleblower report by using the 8-digit case identification number (specified in our letter) and the password that you specified at the time of submission, and thus, your status “submitted” in the electronic system will automatically change to “identified”.
In this case, you have the opportunity to record your report and attach documents in the secure electronic system with the help of the Complaints Office. It is only possible to attach documents to your public interest disclosure via the secure electronic system. This means that the documents sent via email or by post can not be integrated into the secure electronic system.
According to Section 7 (4) of the Complaints Act, the name and address of the reporting person/whistleblower must be stored in the secure electronic system for identification. Entering an email address is not mandatory, however, in its absence, it is not possible to replace a forgotten password.
The reporting person/whistleblower can request anonymity, i.e. that his/her personal data only be accessible to the Commissioner for Fundamental Rights and his office. However, if it becomes obvious that the whistleblower acted in bad faith, and this leads to a crime or violation; has caused damage or other rights violations to others, their data may be transferred to the body or person authorized to initiate or conduct the procedure.
The follow-up of the public interest disclosure is guaranteed by using the case ID number and the password used during login for the first time.
The Office of the Commissioner for Fundamental Rights forwards the report and its attachments – in accordance with the relevant request without personal data, to the competent authority to proceed with the examination within 8 days. The competent authority records the information about the measures taken during the investigation/inquiry in the electronic system, of which - upon request the Office of the Commissioner for Fundamental Rights will also informs the whistleblower by mail.
You can log in to our website (https://www.ajbh.hu) using your case ID number and password together. After you can see the status of the case and belonging documents using the menu items Administration / Inquiry after my public interest disclosure / whistleblower report. If you have forgotten your password, please click on the "forgot password" menu item after entering the case ID number and the code shown in the image on the "public interest announcements in progress" page. The system sends an automatic message and you have to click on the link that appears within the specified time, then you need to enter the new password twice and the system informs you that the password has been changed successfully. Finally the "back to the login page ” text appears, in order to access the data and documents of the case.

When a new document is uploaded, the system notifies you in an automatic message. If you submitted your report without identification, you will not be able to enter the system, so please be patient until the OCFR response letter is delivered by post/email. The letter of the competent authority and the message about closing your case in the electronic system can also take place at different times. The system also sends the message when the case is closed, but if you receive a system message after the response of the competent authority, you have nothing further to do.
According to Section 10 of the Complaints Act, a public interest disclosure / whistleblowing report that is received by the electronic system, and in a case pursuant to Section 9(1) of the Complaints Act, an excerpt thereof, shall be forwarded to the body entitled to proceed.
After the investigation of the public interest disclosure the reporting person can - in order to correct the alleged wrongdoing - submit a petition to the Commissioner of Fundamental Rights if, in his opinion, his/her report was not fully investigated by the competent authority, if he/she does not agree with the result of the investigation, if his/her report was considered unfounded.
Based on the request of the reporting person, the Commissioner of Fundamental Rights examines the appropriate handling of the public interest notification. On the basis of the conducted inquiry, the OCFR can take recommendations to the competent authority.
