Legal remedy
In the framework of the administrative procedure, it is not possible to lodge an appeal against a decision adopted by the Commissioner for Fundamental Rights on the basis of Ebktv (Act on Equal Treatment and the Promotion of Equal Opportunities). However, an administrative lawsuit may be filed against the decision with reference to the violation of the law.
The administrative lawsuit may be filed within 30 days from the delivery of the decision through a written petition submitted to the Commissioner for Fundamental Rights and addressed to the Budapest-Capital Regional Court. The duty to be paid for the administrative procedure is HUF 30,000, the party that submits the claim has the right for the suspension of payment of duties. Legal representation is mandatory before the Budapest-Capital Regional Court.
The person obliged to administer the affairs electronically, including the client’s legal representative, shall submit the petition via the Office Gateway of the Office of the Commissioner for Fundamental Rights (KRID: 420418398) on form AJBH K01 using the form submission support service.
